A Letter from the United States Department of the Treasury:
We have received a letter from this agency stating that
"placing processed tobacco in packages of less than ten ( 10) pounds creates a tobacco product, a taxable commodity which may only be produced at the bonded premise of a tobacco product manufacturer.”
They seem to be saying that if strip or processed tobacco is put in bags of 10 pounds or less, it is a tobacco product. If it is placed in bags of 10.1 pounds or more, it is not a tobacco product. It is like making wine into water or water into wine. It is magic like “ now you see it, now you don’t.”
As you know, strip or processed tobacco is tobacco leaves with the midrib stem removed. To our knowledge processed tobacco until now has never been determined to be a tobacco product. Millions of pounds of processed tobacco have been and are bought, sold, and transported without being considered taxable.
Their letter and this statement are in conflict with this provision of the Internal Revenue Code. It would seem reasonable and logical to think that an Act of Congress would trump a regulatory decision.
THE BOTTOM LINE: The recent Department of the Treasury letter contradicts the Internal Revenue Code and previous statements of the agency that“ no tax is due until a product is made.” Until this issue is resolved, you will need to purchase your strip tobacco in 12 pound bags. This isn’t all bad because it reduces your cost per carton from $8.33 a carton to $7.33 a carton.

When you use natural tobacco, you'll want the moisture to be about 13% of the total weight of the tobacco.
